Can you build a garden shed or outbuilding without a permit?

You’re probably already itching to get started. But before you break ground, there’s one important question: can you just go ahead and build a garden shed or outbuilding without a permit? In many cases, yes. Although there are a few rules you need to keep in mind. How big can you build? Where exactly can you place your outbuilding? And when do you actually need a permit? When can you build a garden shed without a permit?
Good news: In Flanders, in many cases, you can build a garden shed or freestanding outbuilding without a permit. Examples include a garden shed, carport, sunroom, pool house, or garage. However, this exemption applies only if you meet certain conditions.
The most important one? Your outbuilding must be freestanding. As of March 1, 2026, any addition built directly against your home will always require a permit. Not sure? Then it’s a good idea to check this in advance. It will save you a lot of trouble later on.
Where are you allowed to build a garden shed?
The location of your garden shed is also important. You can build an outbuilding without a permit within a 30-meter radius of your home. Is it located farther away in the garden? Then you will need a permit.
In addition, you need to take the property boundaries into account:
at least 3 meters from the side property line;
at least 1 meter from the rear property line;
Is there already an existing partition wall? If so, you can build right up against it.
In other words: it always pays to measure carefully before you start.
What is the maximum size allowed for an outbuilding that does not require a permit?
There are also clear rules regarding floor area. The total floor area of all detached outbuildings on your lot may not exceed 40 m ².
So, if you already have a 20 m² garden shed and want to add a 25 m² sunroom later, you’ll exceed the limit and will need a permit.
The height is also limited.
maximum cornice height: 3 meters
maximum ridge height: 4.5 meters
As long as you stay within those limits, you'll usually be fine.
Can you use a garden shed as an office or a tiny house?
This is where a lot of people make a mistake.
An outbuilding that does not require a permit may not be used for residential purposes. It is intended for:
storage
maintenance
relaxation
A tiny house, guest house, or full-fledged residential unit therefore cannot be built without a permit.
Even if you want to build a fully equipped workshop or an independent practice, it’s best to check in advance which regulations apply.
Don't forget the rainwater
When planning a new outbuilding, you probably think first of the foundation, the roof, or the interior design. However, rainwater drainage is also important. According to Flemish regulations, rainwater must be allowed to infiltrate the soil as much as possible. That is why the gutter of a permit-exempt outbuilding cannot simply be connected to the sewer system. It’s a small change that makes a big difference in water management.
Do you need an architect?
That depends entirely on your project. If you don't need a permit and you meet all the requirements, then hiring an architect is usually not required.
If your project is larger, taller, or falls outside the exemption rules, you’ll need both a permit and an architect.
Please note: Your municipality may impose stricter rules
This is where things sometimes go wrong. Although Flanders has established general rules, municipalities are allowed to impose additional regulations. In addition, separate rules apply when:
Your home is located in a protected heritage area
your property is located in a nature area, forest, or other environmentally sensitive area
you want to build a treehouse.
In those situations, a permit is often still required. Therefore, always check the local regulations before you start the work. That way, you can be sure that everything is done according to the rules.
